The ACC wishes to remind all public officers that Section 119 (1) of the Anti-Corruption Act (ACA) 2008, requires all Public Officers to declare their Income, Assets and Liabilities to the Commission and the period of declaration is from 1st January to 31st March each year.
Public Officers who have not complied with the declaration process are further reminded of Section 122 (a) of the ACA 2008, which stipulates that; it is an offence if a Public Officer fails to declare his/her assets, and upon conviction will pay a fine of not less than twenty million Leones (Le20, 000,000) or imprisonment for a term not less than one year or to both such fine and imprisonment.
Also, one of the objects of the Commission is to take all steps necessary to prevent, suppress and eradicate corruption and corrupt practices. In line with this mandate, the Commission is putting all defaulting persons on notice that the ACC will soon publish the names of all Public Officers who have fully declared their Assets for 2017.
In addition to the above, appropriate action shall also be taken against defaulting Public Officers including but not limited to withholding their salaries, after consultation with the Ministry of Finance and Economic Development and the Accountant General’s Office.
