Judge Releases Accused For Want Of Prosecution

Police further alleged that on diverse date between 15th October 2015 within the Freetown Judicial District ,Timothy Tarawally fraudulently converted three hundred eighty two cements blocks valued at three million six hundred thousand leones which was entrusted to him by the complainant, Steven Nyafor for safe keeping but converted it into his personal use and benefit contrary to law.

Before acquitting and discharging Timothy Tarawally, Justice Ernest Gooding told the court that, since the Timothy Tarawally commenced trail before him, the prosecution could not provide any evidence that warrants him to proceed with the trial of Timothy Tarawally.

He said no evidence was led and neither the complainant nor witness or witnesses were brought forward by the prosecution to lead evidence in respect of the charged against the Timothy and he was never granted bail at the magistrate court.

Justice Ernest Gooding informed the court that, such a matter should not be brought before him on the legal grounds that, considering the offence for which Timothy was charged to court, with no evidence against him, he said he is of the opinion that, if Timothy was rich with a swanky dress in the west part of the country’s capital Freetown, he will not have been incarcerated for so long with no evidence brought against him.

In another development, Magistrate Abubakar Binneh Kamara of Court N0.1 in Freetown has remanded Ibrahim Bai Kamara at the Male Correctional Centre for offence of Larceny contrary to Section (2) of the Larceny Act of 1916 of the laws of Sierra Leone.

 

The particulars of the offence states that, Ibrahim Bai Kamara allegedly stole the sum of six hundred united state dollars equivalent to three million leones from the complainant, Jenneh Baimah at 3 Savage street , Brima Lane in the east part of  Freetown on 6th December 2015 contrary to law.
