The presiding magistrate commented that after thoroughly perusing the evidence adduced by the court during the preliminary trial of the accused person, he realized that the accused had a case to answer, as far as the charge preferred against him was concerned.
Dauda Kekura Daramy was charged with the offence of sexual penetration of a child under the age of eighteen, contrary to Section (19) of the sexual offences act of 2012, of the country’s laws.
The particulars of the offence stated that the accused penetrated the sexual organ of a thirteen years old girl at Circular road, within the Freetown judicial district in the Republic of Sierra Leone, on 23 August 2016.
The prosecution witness, Foday Maligie Bangura who was led in evidence by the police prosecutor, Leslie Pratt intimated his audience that he was attached to Family Support Unit (FSU) at the Lumley  Police Station, and also recognized the accused, including the victim name withheld.
He told court that he remembered the incident of 23 August 2017, and on the said date, he was on duty at the Family Support Unit at the Lumley Police Station, when the complainant Muctar Ibrahim Sesay and other relatives reported an alleged case of sexual penetration on behalf of the victim, against the accused.
He further intimated the court that the matter was allocated to him for further investigation, and he later issued a police medical request form to the victim for examination and treatment at the Rainbow Centre, Princess Christian Maternal Hospital on Fourhbay road in the east of Freetown.
According to the witness, the complainant presented a photo copy of the victim’s under five card to ascertain her , which was produced for identification, and added that while investigation was ongoing, the accused fled to the eastern district headquarter town of Kenema, where he was arrested and brought down to Freetown and charged to court.
 He also stated that on 13 December 2016, detective police constable 13179 Conteh A M obtained voluntary caution statement from the accused by observing the judges rule, and the accused validated his statement by affixing his right hand thump print.
The witness concluded that on 16 February 2017, 09909 Koba K including him charged the accused, Dauda Kekura Daramy with offence of sexual penetration contrary to Section (19) of the sexual offences act of 2012, of the laws of Sierra Leone.
However, Magistrate Dr. Binneh Kamara granted bail to the accused in the sum of eighty million leones including two sureties in like sum, and that sureties should produced a title deed, national identity cards, and bail to be approved by the Master and Registrar of the court.
