Accused Kandeh Dumbuya is alleged to have penetrated the sex organ of a six years old girl between Thursday 1st November 2018 and Friday 16 November 2018 at the Presbyterian Elementary School, High Brand Street Murray Town in the west part of Freetown.
He was arrested on 16th January this year and detained at the Congo Cross Police Division, before he was eventually charged to court.
Testifying in court, the victim (name withheld) disclosed that she is class one pupil and recognized the accused person, Kandeh Dumbuya as a cleaner at the Presbyterian Elementary School.
She informed the court that between the aforementioned dates of the incident, she was playing in the school compound, when the accused person called her into one of the class rooms.
The victim continued that when she entered the class room, the accused person Kandeh Dumbuya grabbed and root out her pant, before the accused person penetrated her sex organ.
When I returned home, the victim said she informed her aunt about what had transpired between her and the accused person, adding that her aunt later informed her father, Osman Banda Moi Gbabai who accompanied her to the Congo Cross Police Division.
The second prosecution witness, Detective Police Sergeant 11234 Charles Conteh also testified that he is attached to the Family Support Unit (FSU) at the Congo Cross Police Division, and recognized the accused person, Kandeh Dumbuya.
He told the court that he recalled the incident of 17th November 2018, and that on the day in question he was on duty at the Congo Cross Police Division, when the victim reported a case of sexual penetration against the accused person.
Detective Police Sergeant Charles Conteh further testified that the matter was then allocated to him for further investigation, after which he issued police medical request form to the victim for examination and treatment at the Rainbow Centre, Princess Maternity Memorial Hospital along Fourah bay Road in Freetown.
According to the witness, the victim later returned with the endorsed police medical request form, before he obtained statement from the victim and the accused person, Kandeh Dumbuya by observing the judge’s rule.
He concluded that on 16th January 2019 he eventually charged the accused person with the offence of Sexual Penetration of a Child under the age of eighteen years.
