The witness was led in evidence by State Counsel, J A K Sesay before Justice, Monfred Sesay of the High Court of Sierra Leone, and he  testified that he recognized the accused, and the lead investigated of the matter being adjudicated, Detective Sergeant , 1513 Mohamed Dauda Kabba, who recently succumbed to the cold hands of death.
He told the court that he vividly recalled the incident of 17 December 2015, and on the date in question, he together with late police sergeant Mohamed Dauda Kabba who was attached to the Homicide Department at the Criminal Investigations Department in Freetown, received an enquiry and case file relating to an alleged murder, from Central Police Station on Wallace Johnson street in Freetown for further investigation.
According to Detective Police Constable 8704 Bai Ibrahim Turay, he was attached to the Criminal Investigation Department headquarters on Pademba road in Freetown, and furthered that accused Jonathan Decker, was later identified to them on 18 December 2015.
He informed the court that between 17 and 25 December 2015, the accused was whisked to the scene of crime at # 117 Pademba road in Freetown capital and where he identified to them one old machete, which he allegedly used to kill his brother, and they recorded it as exhibit.
Whiles they were at the scene of crime at the above stated residence, the witness said the accused handed over to them the said cutlass, and it had since been in the custody of the police.
The witness went on to tender the said cutlass in evidence, after it had been produced and identified, and he went further to state that he and late Mohamed Dauda Kabba obtained voluntary caution statement from the accused, by applying the judges rule, before the accused could validated his statement by appending his signature, and the said statement was tendered in evidence, as part of the court records in respect of the matter before the court.
Furthermore, the fifth prosecution witness, Police Sergeant, 1516 Abu Conteh who is ‘Exhibit Clerk’ also testified that he was attached to the Crime Writers Office at the Criminal Investigations Department headquarters in Freetown.
According to him, he was charged with the responsibility of taking custody of exhibits brought to his office in respect of cases that had been reported and investigated, and he could also remembered the accused person.
He told his audience that he recalled 22 January 2016, stating that whiles he was on duty at the Criminal Investigations Department, Police Sergeant Mohamed Dauda Kabba, now deceased handed over to him one old damaged machete as exhibit.
The witness said he registered the said cutlass in the court exhibit book, with serial number 06-2016, and it had since been in the custody of the police, before he tendered the said exhibit before Magistrate Fidawi of court N0. 7 in Freetown, when the matter was initially charged to court, after which it was committed to high court for trial.
The matter comes again on Wednesday 2 August 2017.
